Prospective Marriage Visa (Subclass 300)

For engaged couples where one partner is outside Australia. Allows entry to Australia to marry, after which a Partner Visa can be lodged to remain permanently.

What Is the Prospective Marriage Visa?

The Subclass 300 — often referred to as the fiancé visa — is a temporary visa for someone who is engaged to an Australian citizen, permanent resident or eligible New Zealand citizen and is currently living outside Australia. It allows the overseas partner to travel to Australia for the purpose of getting married, with a 9-month window in which the marriage must take place.

Once married, the visa holder can lodge a Partner Visa (Subclass 820/801) from within Australia to begin the pathway to permanent residence. Our immigration lawyers manage both the 300 application and the follow-on 820/801 lodgement — ensuring there are no gaps in your immigration status along the way.

Eligibility Requirements

Important: The Subclass 300 can only be lodged from outside Australia. If your partner is already in Australia, the correct pathway is the Subclass 820/801 Partner Visa — which can be lodged onshore, including before the wedding in some circumstances.

After Marriage — What's Next?

Once you have married in Australia on your Subclass 300 visa, you can immediately lodge the Partner Visa (Subclass 820/801) from within Australia. A Bridging Visa is issued on lodgement, allowing you to remain lawfully in the country while your partner visa is processed. Our team handles both applications from start to finish, so the transition from your 300 visa to your partner visa is seamless.
