What Is a Nomination Application?
Once your business holds Approved Standard Business Sponsor status, the next step before a visa can be lodged is to nominate the specific position you want to fill. A nomination is your business’s formal request to the Department of Home Affairs to approve a particular role, occupation, salary and worker. The visa application cannot proceed until the nomination is approved.
Every nominated position is assessed against strict criteria — the correct occupation code, a genuine business need, salary compliance and Labour Market Testing where required. A poorly prepared nomination is one of the most common causes of delays and refusals in the employer sponsorship process. What We Assess in Your Nomination
Occupation Assessment
- Correct ANZSCO occupation code for the role
- Role genuinely matches the nominated occupation (not just job title)
- Role genuinely matches the nominated occupation (not just job title)
- Worker's skills and experience align with the ANZSCO requirements
Salary Assessment
- Salary meets or exceeds the TSMIT (currently $73,150)
- Salary is at least equal to the Annual Market Salary Rate (AMSR)
- No adverse distinction between the overseas worker and Australian equivalents
- Total Employment Cost (TEC) correctly calculated
Labour Market Testing (LMT) — What It Involves
Labour Market Testing (LMT) requires employers to demonstrate genuine efforts to recruit an Australian worker before turning to overseas sponsorship. For most Core Skills stream Subclass 482 nominations, the requirements include:
- Advertisement on at least 2 approved platforms (e.g. Seek, Indeed, LinkedIn, or industry-specific platforms)
- Advertising period of at least 4 consecutive weeks, within 4 months of nomination lodgement
- Advertisements must include position title, duties, salary or salary range, and employer name
- Records of every application received and reasons why Australian applicants were not suitable
- If no suitable Australian applicants were found, this must be demonstrably genuine — not tokenistic
LMT records must be retained for a minimum of 2 years.
